AIMangaMaker respects the intellectual property rights of others and expects our users to do the same. This Copyright & DMCA Policy explains how we handle copyright claims and comply with the Digital Millennium Copyright Act (DMCA).

1. Copyright Ownership

1.1 Your Content

You retain ownership of all original content you create on AIMangaMaker, including:

  • Original manga, manhwa, and novel projects
  • Original characters, storylines, and artwork
  • Text content you write

1.2 AI-Generated Content

IMPORTANT: AI-generated content may not be eligible for copyright protection in some jurisdictions.
  • Content generated using AI tools may have limited or no copyright protection
  • Laws regarding AI-generated content are evolving
  • Consult a legal professional if you plan to commercially exploit AI-generated content
  • You are responsible for verifying the copyright status of AI-generated content

1.3 Platform Content

AIMangaMaker owns all rights to:

  • The AIMangaMaker website, applications, and software
  • AIMangaMaker branding, logos, and trademarks
  • Platform features, design, and user interface
  • Documentation, tutorials, and marketing materials

2. User Responsibilities

2.1 Prohibited Copyright Violations

You may NOT upload, create, or publish content that:

  • Copies existing characters: Using characters from existing manga, anime, movies, or books without permission (e.g., Naruto, One Piece, Dragon Ball)
  • Traces or copies artwork: Copying someone else's art and claiming it as your own
  • Plagiarizes stories: Copying plots, dialogue, or narrative elements from copyrighted works
  • Uses copyrighted images: Uploading images you don't own or have permission to use
  • Infringes trademarks: Using real company logos, brand names, or trademarks without permission

2.2 What IS Allowed

✅ Acceptable Uses:

  • Original creations ONLY: Your own characters, stories, and artwork
  • Public domain works: Content where copyright has expired (typically 70+ years after creator's death)
  • Licensed content: Content you have explicit written permission to use
  • AI-generated with original prompts: Content created using AIMangaMaker's AI tools with your original creative input
NO FAN FICTION OR FAN ART: AIMangaMaker is dedicated to original content creation. Fan fiction, fan art, parody, and derivative works based on existing copyrighted properties (manga, anime, movies, games, books, etc.) are strictly prohibited.

2.3 Attribution and Credit

  • Credit sources when using public domain or licensed content
  • Do not claim ownership of work you did not create
  • Respect Creative Commons licenses and their requirements
  • When in doubt, create original content

3. DMCA Takedown Procedure

If you believe your copyrighted work has been infringed on AIMangaMaker, you can file a DMCA takedown notice.

3.1 Requirements for a Valid DMCA Notice

Your DMCA takedown notice must include:

  1. Identification of the copyrighted work you claim has been infringed
    • Provide a description of the work
    • Include a link or reference to the original work
    • Attach proof of copyright ownership if available
  2. Identification of the infringing material on AIMangaMaker
    • Provide the URL of the infringing content
    • Include screenshots or specific descriptions
    • Be as specific as possible (project ID, page number, etc.)
  3. Your contact information:
    • Full legal name
    • Mailing address
    • Email address
    • Phone number
  4. Good faith statement: A statement that you have a good faith belief that the use is not authorized
  5. Accuracy statement: A statement under penalty of perjury that your notice is accurate
  6. Physical or electronic signature of the copyright owner or authorized agent

3.2 How to Submit a DMCA Notice

3.3 What Happens After We Receive Your Notice

  1. Acknowledge receipt within 24-48 hours
  2. Review the notice for completeness and validity
  3. Remove or disable access to the allegedly infringing content within 2-3 business days
  4. Notify the uploader that their content has been removed and provide your notice (with personal info redacted)
  5. Provide counter-notification option to the uploader (see Section 4)

3.4 False Claims Warning

WARNING: Submitting a false DMCA notice is perjury and may result in legal consequences, including liability for damages, attorney's fees, and court costs.

Only file a DMCA notice if you have a genuine belief that your copyright has been infringed.

4. Counter-Notification

If your content was removed due to a DMCA notice and you believe the removal was mistaken or that you have the right to use the material, you can file a counter-notification.

4.1 Requirements for a Valid Counter-Notification

Your counter-notification must include:

  1. Your contact information:
    • Full legal name
    • Mailing address
    • Email address
    • Phone number
  2. Identification of the removed material and its location before removal
  3. Good faith statement: A statement under penalty of perjury that you have a good faith belief the material was removed due to mistake or misidentification
  4. Consent to jurisdiction: A statement consenting to jurisdiction in your location or where AIMangaMaker is located
  5. Physical or electronic signature

4.2 Counter-Notification Process

  1. We receive your counter-notification
  2. We forward it to the original complainant
  3. The complainant has 10-14 business days to file a court action
  4. If no court action is filed, we restore your content within 10-14 business days
IMPORTANT: By filing a counter-notification, you may expose yourself to legal action. Consult an attorney if you're unsure.

5. Repeat Infringer Policy

5.1 Three-Strike Policy

AIMangaMaker operates a repeat infringer policy:

  • First Offense:
    • Content removed
    • Warning issued to user
    • Educational notice about copyright
  • Second Offense:
    • Content removed
    • 7-day account suspension
    • Final warning
  • Third Offense:
    • Permanent account termination
    • IP ban from creating new accounts
    • No refund of credits or subscriptions

5.2 Egregious Violations

For severe copyright infringement (e.g., uploading entire copyrighted manga series), we may terminate accounts immediately without prior warnings.

5.3 Appeals

If you believe you were wrongly identified as a repeat infringer, you may appeal to [support email] with evidence of:

  • Valid counter-notifications that were upheld
  • Licenses or permissions you obtained
  • Fair use justifications

6. Fair Use and Exceptions

6.1 What is Fair Use?

Fair use is a legal doctrine that allows limited use of copyrighted material without permission for purposes such as:

  • Criticism and commentary
  • Parody and satire
  • News reporting
  • Teaching and education
  • Research

6.2 Fair Use Factors

Fair use is determined by four factors:

  1. Purpose and character: Is the use transformative? Is it commercial?
  2. Nature of the work: Is the original factual or creative?
  3. Amount used: How much of the original work was used?
  4. Market effect: Does the use harm the original work's market value?
IMPORTANT: Fair use is complex and fact-specific. Just claiming "fair use" does not automatically protect you. If unsure, consult a copyright attorney.

6.3 Fan Fiction and Fan Art

Fan Works on AIMangaMaker:

  • Allowed: Fan works clearly labeled as such and not claiming official status
  • Required: Disclaimer stating it's unofficial fan content
  • Not Allowed: Selling fan works or profiting from others' IP
  • Risk: Copyright owners may still request removal even if labeled as fan content

Best Practice: If creating fan content, clearly label it as "Fan Art" or "Fan Fiction" and include a disclaimer like:

"This is a non-commercial fan work. All characters and settings belong to [Original Creator/Company]. No copyright infringement intended."

7. AI-Generated Content and Copyright

7.1 Legal Uncertainty

Copyright law regarding AI-generated content is evolving. Key considerations:

  • Some jurisdictions do not grant copyright to AI-generated works
  • The degree of human creative input may determine copyrightability
  • Different countries have different approaches to AI-generated content

7.2 Your Rights to AI-Generated Content

  • What you own: You own the final product you create using AIMangaMaker's AI tools
  • Limitations: Your ownership may not be recognized as "copyright" in all jurisdictions
  • Commercial use: You can use AI-generated content commercially, but copyright protection may be limited
  • Third-party AI terms: Content is also subject to OpenAI, Claude, and Gemini terms of service

7.3 AI Training Data Concerns

AI models may have been trained on copyrighted material. While we believe this constitutes fair use for training purposes:

  • Generated content may occasionally resemble existing copyrighted works
  • You are responsible for reviewing AI-generated content for potential infringement
  • If AI generates content too similar to existing works, modify or don't use it

7.4 Recommendations for AI-Generated Content

  • Add human creativity: Edit, refine, and add original elements to AI-generated content
  • Use as a starting point: Treat AI output as a draft, not a final product
  • Review for similarity: Check that AI output doesn't closely copy existing works
  • Keep records: Document your prompts and creative process
